Privacy Policy

This "Privacy Policy" is part of the Terms of Use located at http://www.intelligolf.com/copyrightnotice.asp for IntelliGolf, Inc., and its associated websites (collectively, the "Website"). This Privacy Policy covers the Website and is designed to assist You in understanding how we will use the information You provide when You use the Website, as well as how we will use other information that we collect based on that use. By using the Website, You consent to the information collection and use practices described in this Privacy Policy.

"Personal Information" means information that would allow a third party to learn your identity or contact You, including, for example, Your full name, address, location, telephone number, or email address.

Please read this Privacy Policy to learn more about the ways in which we collect, use and protect Your Personal Information. If we make any material changes to this Privacy Policy, we will post such updates on the IntelliGolf web site for Your review.

Disclosure of Personal Information

We do not sell or rent Your Personal Information to third parties for the purposes of marketing the products or services provided by those third parties to You. We use other third parties to provide Web analytics on our site and to host our web site. We are not a web hosting provider nor do we offer web hosting services. When You sign up for IntelliGolf.com access, including but not limited to use of the IntelliGolf course database, we may share aggregate click data, and course access data, as necessary for providing such access. Although we may disclose aggregated information about the use of our Website, that information does not contain Personal Information. We may share Personal Information with our contractors and service providers solely for the purpose of maintaining, enhancing, or adding to the functionality of the Website and/or to our line of products. In the case of criminal investigations, including but not limited to fraud or alleged illegal activity, we may share Your Personal Information with law enforcement, government, and/or credit card issuing banks. However, we will not share any of Your Personal Information (e.g. name, email address, address, location, phone number, et cetera) about you unless ordered to do so by a Court, located in the State of California, and of competent jurisdiction.

In accordance with California Civil Code Section 1798.83, we will not provide Your Personal Information to third parties for their marketing purposes. California residents may request further information about our compliance with this law by emailing us at legal@intelligolf.com. Please note that we are only required to respond to one request per customer per year and we are not required to respond to requests made by means other than through this email address.

As IntelliGolf, Inc., continues to develop its business, IntelliGolf, Inc., might sell or buy lines of business or assets. If all or substantially all of IntelliGolf, Inc’s business (or a line of business) or assets (or the assets of a line of IntelliGolf, Inc’s business) are acquired by a third party, Personal Information of IntelliGolf, Inc., users will generally be one of the transferred business assets. We reserve the right to include Your collected Personal Information and other information we collect as described herein as an asset in any such transfer to a third party.

Information We Collect and How We Use That Information

Our basic registration forms require Users to provide some contact information, which may include Your name, email address, location, and password (i.e. mainly for accessing the IntelliGolf course database). We use this information to allow you to access the IntelliGolf course database and to contact You about the products on our Website in which You have expressed interest or about enhancements or changes to the Website and/or to IntelliGolf, Inc’s products.

In Your use of the Website or IntelliGolf, Inc’s mobile or desktop applications, we may store such information on our servers. Your name and contact information will not be disclosed through such features and shall not be disclosed to any non-affiliated party unless ordered to do so by a Court, located in the State of California, and of competent jurisdiction.

We use other third parties to provide credit card processing services on our Website. When You sign up for Pay-per-Incident Support, we will only process Your full payment information including credit cards through a third party payment processor (e.g. PayPal) that is Payment Card Industry Data Security Standard (PCI DSS) compliant https://www.pcisecuritystandards.org/security_standards/.

We post reviews on our Website, which may contain Personal Information such as the user’s name or the customer's name. We try to obtain the user’s or customer's consent prior to posting the review to post their name along with their review, but such consent is not required.

If Your Personal Information changes, or if You wish to cancel your account, You may correct, update, or deactivate it by making the change on our member information page or by emailing our Customer Support at info@intelligolf.com.

We will retain and use your information as set forth herein and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Newsletters

As part of your IntelliGolf course database access rights, you will be automatically subscribed to our email communications (i.e. newsletter). We may use Your name and will use your email address to send the newsletter to You. We provide You with a way to way to unsubscribe. Please see the "Unsubscribe/Opt-out" section as the bottom of each newsletter for further information.

Choice/Opt-out

When You register for our Website (mainly for accessing the IntelliGolf course database), we use Your email address to send You internal communications from IntelliGolf, Inc. If you are receiving email communications from us and later change Your mind, You may contact us to have Your name removed from our distribution lists. You may opt-out of any of our communications. Please send us an email at info@intelligolf.com and indicate from which distribution lists You would like to have Your name removed. Please be advised that removing yourself from our newsletter distribution list will also remove your access privileges to the IntelliGolf course database.

Internet Protocol Address

Like most websites, we collect Internet Protocol ("IP") address from all visitors to the Website. An IP address is a number that is automatically assigned to Your computer when You use the Internet. We use IP addresses to help diagnose problems with our server, administer our Website, analyze trends, track users' movement, gather broad demographic information for aggregate use in order for us to improve the Website, and deliver customized, personalized content.

IntelliFriend

If You choose to use our referral service to tell a friend about our site, we will ask You for Your friend's name and email address. We will automatically send Your friend at least one (1) email inviting him or her to visit the site. IntelliGolf, Inc., stores this information for the sole purpose of sending this email, tracking the success of our referral program, and following up with additional information if the friend has opted-in.

Your friend may contact us at info@intelligolf.com to request that we remove this information from our database and distribution list(s).

Use of "Cookies"

Like most websites, we may use cookies to enhance Your experience on our Website. Cookies are pieces of information that some websites transfer to the computer that is browsing that website and are used for record-keeping purposes. Use of cookies makes web-surfing easier by performing certain functions such as saving Your passwords and Your personal preferences regarding Your use of the particular website. We do link the information we store in cookies to any Personal Information You enter into Your account settings on the Website. This link is only used internally for Website usage tracking, course database access, and for re-marketing IntelliGolf, Inc’s products to you.

If You choose to have Your browser refuse cookies, our Website will not function properly.

IntelliGolf, Inc., has implemented and follows industry standard measures to protect against unauthorized access to and unlawful interception or processing of Personal Information. Unfortunately, no data transmission over the Internet is 100% secure. While we strive to protect Your Personal Information, we cannot ensure or warranty the security of any such Personal Information.

Please note that when You click on one of these links, You are entering another website over which IntelliGolf, Inc., has no control and will bear no responsibility.
